The Department of Environmental Quality proposed to adopt new rules under Mont. Admin. R. 90-4-11, concerning energy performance contracting. The new rules would, among other things, ensure that qualified energy service providers are contracting and providing services in accordance with Mont. Admin. R. 90-4-11, provide a stand-alone provision setting forth all requirements regarding requests for proposals, clarify that cost-effectiveness is determined based on an entire project, and set a minimum term for energy performance contracts. A hearing will be held September 6, 2018.
