FWS and NMFS finalized revisions to portions of their regulations that implement §4 of the ESA, concerning procedures and criteria used for listing, reclassifying, and delisting species on the lists of endangered and threatened wildlife and plants and designating critical habitat.

United States v. Kyocera AVX Components Corp., No. 1:24-cv-305 (W.D.N.Y.  Apr. 1, 2024). Under a proposed consent decree, a settling CERCLA defendant must perform remedial action at the Olean Wellfield Superfund Site in the City of Olean, the Town of Olean, and the Town of Portville, New York, and reimburse EPA for its past and future costs regarding the remedial action.

FWS revised the rule for the African elephant promulgated under §4(d) of the ESA in order to increase protection for the species, clarify the existing enhancement requirement, and incorporate a Party’s designation under the Convention on International Trade in Endangered Species of Wild Fauna and Flora National Legislation Project into various decisionmaking processes regarding imports.

EPA entered into a proposed administrative settlement agreement for remedial investigation addendum/focused feasibility study under CERCLA associated with the Smeltertown site near Salida, Colorado. 

EPA issued a rule under TSCA to address the unreasonable risk of injury to health presented by chrysotile asbestos based on the risks posed by certain conditions of use. 

EPA proposed to require manufacturers of 16 chemical substances to submit copies and lists of certain unpublished health and safety studies to help inform EPA’s responsibilities pursuant to TSCA. 

FWS withdrew the September 7, 2021, proposed rule to list the pyramid pigtoe as a threatened species under the ESA.
