Louisiana: Air

The Department of Environmental Quality proposed amendments to regulations governing emissions standards for asbestos. The amendment would clarify that isolated individual residences demolished by individuals or local governmental units are exempt from the requirements outlined in La. Admin. Code tit. 33, pt. Colorado: Toxic Substances

The Department of Agriculture adopted amendments to regulations governing the administration and enforcement of the Pesticide Applicators’ Act. The amendments clarify new federal certification categories under 40 C.F.R. Part 171 by differentiating the 309 Soil/Non-Soil Fumigation category into subcategories that address soil and non-soil fumigation applications and removing the term "agricultural" from the Aerial Pest Control category definition.

Colorado: Waste

The Department of Public Health and Environment proposed amendments to regulations governing solid and hazardous waste commission fees. The amendments would not change the amounts of the annual commission fees, but would change the regulations to reflect the 2024-2025 fiscal year. A hearing will be held May 21, 2024. Comments are due May 8, 2024.

Colorado: Waste

The Department of Public Health and Environment proposed amendments to regulations governing the remediation of closed solid waste landfills. The amendments would establish how the Department will administer the grant program for the remediation of closed solid waste landfills owned by eligible local governments in Colorado. A hearing will be held May 21, 2024. Comments are due May 8, 2024.

California: Natural Resources

The Department of Conservation proposed to adopt new regulations governing underground gas storage chemical inventory and root cause analysis. The regulations would, among other things, define “gas storage well chemical inventory,” expand operator risk management plans, establish well-specific well control plans, and address prevention and mitigation protocols regarding corrosion evaluation and monitoring. A hearing will be held June 4, 2024.

Under a proposed consent decree, settling CERCLA defendants must collectively pay $2,412,029.89 for reimbursement of response costs incurred in connection with the release of hazardous substances at the former Naval Training Center in San Diego, California.

EPA entered into proposed consent decrees in Community In-Power and Development Ass'n Inc. v. EPA, No. 1:23-cv-02715 (D.D.C.) and ACC v. EPA, No. 1:23-cv-03726 (D.D.C.), that would establish deadlines for EPA to take action on subject risk evaluations under TSCA.
