A settling CWA defendant responsible for violating its NPDES permit and for discharging pollutants into waters of the United States must pay a $675,000 civil penalty to the United States and Illinois, must provide a schedule for completion and post-construction monitoring of its Tunnel and Reservoir Program, must develop a plan to control floatables in Chicago waterways, and must establish a green infrastructure program to reduce combined sewer outfall discharges, localized flooding, and stormwater impacts.

EPA announced the availability of one TMDL under CWA §303(d) for waters listed in Louisiana.

United States v. Wright Brothers Construction Co., No. 2:11- CV-321-WCO (N.D. Ga. Dec. 12, 2011). Settling CWA defendants responsible for the discharge of pollutants into navigable waters must pay a civil penalty, must restore contaminated streams, and must purchase mitigation credits.

EPA Region 6 announced the availability of 28 TMDLs for waters listed in Louisiana under CWA §303(d).

United States v. E.I. Du Pont de Nemours & Co., No. 1:11-cv-01057-UNA (D. Del. Oct. 31, 2011). A settling CWA defendant responsible for violations at its titanium dioxide production facility in Edge Moor, Delaware, must pay a $500,000 civil penalty to the United States and Delaware and must perform a comprehensive engineering study of the wastewater treatment plant and its collection system.

EPA announced a final NPDES general permit for point source discharges from the application of pesticides to waters of the United States.
