United States v. Magnesium Corp. of America, No. 2:01CV0040B (D. Utah Jan. 20, 2021). In connection with U.S. Magnesium LLC's magnesium production facility in Rowley, Utah, settling RCRA defendants must make extensive process modifications to reduce environmental impacts from production operations and ensure greater protection for workers, establish appropriate financial assurance for closure or corrective action of certain waste management areas in the operating areas of the facility, pay a civil penalty, and perform the CERCLA response action.
United States v. American Zinc Recycling Corp., No. 3:21-cv-00098-RDM (M.D. Penn. Jan. 19, 2021). Under the CAA, RCRA, CWA, EPCRA, and state statutes and regulations, a settling defendant must pay a civil penalty and perform a number of actions to reduce and monitor pollutant emissions in connection with its zinc reclamation and processing facility in Palmerton, Pennsylvania.

Circuit's 2018 ruling in Utility Solid Waste Activities Group v. Environmental Protection Agency, which vacated and remanded the provision of the criteria that exempted inactive impoundments at inactive facilities.
