Ms. Darlene Marshall (“Petitioner”) petitions the Environmental Appeals Board (“Board”) to review an Underground Injection Control (“UIC”) permit that U.S. Environmental Protection Agency Region 3 (“Region”) reissued to Windfall Oil & Gas, Inc. (“Windfall”) in December 2020. The permit was issued pursuant to Part C of the Safe Drinking Water Act, 42 U.S.C. § 300h through 300h-8, and the UIC implementing regulations codified at Title 40 of the U.S. Code of Federal Regulations, parts 124 and 144 through 148.
