The Eighth Circuit finds there is no right of annexation under federal law or the United States Constitution. Refusal to annex a residential area completely encircled by a city purely because of the poverty of its residents is not a denial of equal protection under the Fourteenth Amendment, nor is it a deprivation of a constitutional right under color of state law within the meaning of 42 U.S.C. §1983.
