The United States Court of Appeals for the District of Columbia Circuit, sitting en banc, reverses the denial of further injunctive relief against the issuance of a special land use permit for construction purposes on the Trans-Alaska Pipeline Project. The court concludes that the grant of a right-of-way of 200 feet on either side of the pipeline would violate §28 of the Mineral Leasing Act of 1920, which authorizes only 25. The majority refuses to reach claims alleged under the National Environmental Policy Act, holding that they are not yet ripe for adjudication.
