The court dismisses, on the basis of the Supreme Court's recent decision in Union Electric Co. v. EPA, 6 ELR 20570, an industry petition for review of the EPA Administrator's approval of the Pennsylvania air quality implementation plan. Petitioner mistakenly asserts that court of appeals review under §307(b)(1) of the Clean Air Act is the only forum in which it can raise claims of economic and technological infeasibility before a court, and that denial of its petition would therefore violate due process. As the Supreme Court pointed out in Union Electric, such claims are relevant to fashioning an appropriate compliance order and can be raised in enforcement proceedings under §113(a)(4) of the Act.
