United States v. Vulcan Materials Co.

ELR Citation: ELR 20086
No(s). s. 24-70 et al (D.N.J. Sep 24, 1970)

Motion to dismiss criminal information charging New Jersey Manufacturers with the discharge of acids, alkalies and oil into New York Harbor in violation of New York Harbor Act, 33 U.S.C. §441, denied. The statute clearly prohibits the discharge of liquid as well as solid inorganic matter and has not been implicitly repealed by the Federal Water Pollution Control Act, 33 U.S.C. §§466 et seq. (1964).
