United States v. Reserve Mining Co.

The Eighth Circuit affirms the lower court's ruling that Reserve Mining's taconite discharges into Lake Superior must cease on July 7, 1977, barring the parties' resolution of the on-land disposal site controversy. The court also affirms the lower court's assessment of fines, penalties, litigation costs, and sanctions, for reason that Reserve's discharges discolored the water in violation of its state permit, and not, as the lower court held, because "reasonable medical concern" over the discharge's health effects is equivalent to the permit's prohibition of "material adverse effects" to the water.
