United States v. King Fisher Marine Servs.

ELR Citation: ELR 20439
No(s). 80-1379 (5th Cir. Feb 20, 1981)

The Fifth Circuit Court of Appeals reverses a district court and rules that Army Corps of Engineers permits issued pursuant to §10 of the Rivers and Harbors Act require strict compliance. The district court held that although appellee dredged a channel to a greater depth than specifically allowed by his permit, this did not substantially violate the permit. On appeal the court holds that since appellee violated the specific terms of his dredging permit, the lower court erred. Accordingly, the case is remanded.
