The D.C. Circuit Court of Appeals affirms orders issued by the district court (1) requiring the Washington Suburban Sanitary Commission to restore deleted budget funds for acquisition of a sludge disposal site in Montgomery County, Maryland and (2) enjoining related state court proceedings impeding compliance with the district court's orders. The court finds first that the orders do not violate the principles of federalism embodied in the Tenth Amendment. They are supported by an overriding federal interest in water pollution control and are necessary to enforce a regional agreement for sewage disposal by which appellant Prince Georges County previously agreed to abide. The court also upholds the injunction against parallel state court proceedings, concluding that it is necessary to protect or effectuate the federal court's orders and thus comes within an exception to the Anti-Injunction Act.
