Steel Hill Dev., Inc. v. Sanbornton, Town of

ELR Citation: ELR 20018
No(s). 72-1234 (1st Cir. Nov 24, 1972)

The Court of Appeals for the First Circuit affirms a judgment upholding the validity of a zoning ordinance designed to prevent a development that would disturb the ecological balance in the area. The court concludes that the town was not unreasonable in deciding that the general welfare would be advanced by exclusion of an unwanted use in a situation where the ordinance is not likely to frustrate regional development.
