Southern Or. Citizens Against Toxic Sprays v. Andrus
ELR Citation: ELR 20715 No(s). 79-1098 (D. Or. Sep 22, 1979)
The court denies plaintiffs' request for a temporary restraining order against the Bureau of Land Management's spraying of the herbicide 2,4-D on public forest lands. Noting that there is no direct evidence of health problems associated with the spraying of 2,4-D and that the herbicide does not contain the toxic contaminant dioxin, the court rules that plaintiffs have failed to show that irreparable injury will occur pending a hearing on the merits of their request for injunctive relief.
