Sierra Club v. Department of the Interior
ELR Citation: ELR 20605 No(s). C-73-0163-WTS (N.D. Cal. Jun 7, 1976)
The court finds that the Interior Department has complied with its previous order to pursue all statutorily available courses to protect the Redwood National Park from lumbering on the park's periphery. Interior's attempts to secure new funding or new regulatory power to protect the park have been rejected by the Office of Management and Budget. The agency's proposal to enjoin lumbering is under consideration at the Justice Department. Thus, responsibility for protecting the park rests squarely upon Congress, a responsibility over which the court cannot take jurisdiction.
