In re Spring Valley Dev.

ELR Citation: ELR 20589
No(s). 1341 (Me. Feb 9, 1973)

Under the Maine Site Location Law the state's highest court denies a private developer permission to subdivide 92 acres of land fronting on a public pond because the developer failed to demonstrate that his plans would adequately protect the public's interest in the pond. The Site Location Law applies to subdivisions even when the developer has no intention to build on the land or to provide additional services. The constitutionality of the Law is upheld, and the original order of the Environmental Improvement Commission is affirmed.
