In re Cross-Florida Barge Canal

ELR Citation: ELR 20366
No(s). 2655-69 Civil (D.D.C.), No. 71-92 Civil-J, No. 70 (M.D. Fla.) (J.P.M.L. Jul 27, 1971)

Suit brought by conservation organization seeking injunction against construction of the Cross-Florida Barge Canal is consolidated with the suit brought by the Canal Authority of Florida to enjoin the enforcement of the Presidential Order which suspended Canal construction. While the legal issues in the two actions are distinguishable, there are many "ecological questions of fact" common to both. The Middle District of Florida will be the situs of the consolidated litigation, because the disputed canal lies within its jurisdiction.
