The court invalidates the Environmental Protection Agency's (EPA's) "cite-all" pesticide registration regulations as inconsistent with the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA). The court rules that on its face §3(c) of FIFRA requires applicants for EPA registration of pesticides to provide data from their own tests or, alternatively, citations to data in the literature or on file at EPA. The legislative history supports this reading of the statute. EPA rules requiring applicants to cite all relevant data in EPA files in addition to providing their own data conflict with the clear statutory mandate. The court enjoins the Agency from applying the cite-all rule.
