The court dismissed individuals' claims for personal injuries and property damage against a company that contracted with an oil and gas corporation that engaged in radioactive tracer "fracing" near the individuals' property in the early 1990s. The individuals claimed that the fracing contaminated their water well, causing one of them to suffer from neurological disorders. The complaint, however, contains no factual allegations from which it can be inferred that the company was participating in the fracing or is otherwise vicariously liable for the corporation's conduct at that time.
