Maryland Pest Control Ass'n v. Prince George's County
ELR Citation: ELR 20585 No(s). 86-3633 (4th Cir. Jun 16, 1987)
The court affirms a district court decision, 17 ELR 20511, holding that the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) preempts Maryland county regulations requiring commercial pesticide applicators to post sprayed areas and provide notification of pesticide hazards because FIFRA allows only states and not subdivisions of states to regulate pesticides.
