Iowa Citizens for Envtl. Quality v. Volpe

ELR Citation: ELR 20013
No(s). 72-17-1 (S.D. Iowa Nov 30, 1972)

A suit seeking an injunction against the construction of a segment of a federally funded interstate highway on the grounds that there were violations of the National Environmental Policy Act (NEPA) is dismissed. The court holds that the environmental impact statement contains sufficient discussion and consideration of feasible alternatives to the route chosen and decides that responsible federal officials may rely upon the state agency to prepare an environmental impact statement and limit themselves to review and revision.
