Great Oaks Water Co. v. Santa Clara Water Valley Dist.
ELR Citation: ELR 20021 No(s). H032067 (Cal. App. 6th Dist. Jan 28, 2009)
A California appellate court affirmed a lower court decision denying a water company's petition challenging a water district's use of a statutory rate-setting exemption from the California Environmental Quality Act to raise groundwater-charge rates for fiscal year 2006-2007. Although the district's findings could have been more detailed or could have made more specific reference to facts in the record, its findings are sufficient to comply with the statutory rate-setting exemption. In addition, the record contains substantial evidence supportive of the district's finding that the groundwater-charge rate increases were for statutorily exempt purposes.
