Upon direct review, the Ninth Circuit upholds a finding by the Environmental Protection Agency Regional Administrator that defendant had applied a pesticide in a manner inconsistent with the label instructions in violation of the Federal Insecticide, Fungicide, and Rodenticide Act. The record contained substantial evidence supporting that finding and the assessment of a civil penalty of $1,000 is therefore affirmed.
