In response to various motions to transfer six consolidated petitions for review of the EPA regulations which prohibit significant deterioration of air quality in areas where it exceeds national standards, the court holds that the D.C. Circuit is the "appropriate circuit" to decide these review petitions, under §307(b)(1) of the Clean Air Act. The regulations in question are the product of a unitary rulemaking proceeding, are national in scope, and apply uniformly throughout the country. Moreover, they appear to raise no questions of law or fact which will vary from one jurisdiction to another, multiple reviews might result in inconsistent decisions, and, since their promulgation was mandated by the D.C. Circuit, that court is in the best position to determine whether its order has been followed. As there is only one appropriate circuit, 28 U.S.C. §2112(a) has no application here. Mandamus petition to require EPA to file administrative record in this court denied; motion to transfer Ninth Circuit cases back to Ninth Circuit denied; motions to transfer cases to D.C. Circuit granted; all six cases ordered transferred to D.C. Circuit. Costs taxed against petitioners.
