Cockshott v. Department of Forestry & Fire Protection

ELR Citation: ELR 20005
No(s). C045732 (Cal. App. 3d Dist. Dec 22, 2004)

A California appellate court held that the statute of limitations governing the filing of a petition for administrative mandamus challenging a decision of the state's Board of Forestry and Fire Protection is found in California Public Resources Code §4601.3. Consequently, a petition for a writ of mandate filed by a timber operator more than 30 days after he was ordered to pay a $1,000 fine for unlawfully cutting and removing trees without a timber harvesting plan was dismissed.
