Reversing the judgment of the district court, 9 ELR 20625, the court of appeals rules that the Navy must prepare an environmental impact statement (EIS) in connection with the reconstruction of a weapons storage facility to accommodate nuclear weapons. Acepting as true appellees' contention that the Atomic Energy Act forbids disclosure of whether nuclear weapons are in fact stored or planned to be stored at the facility, the court rules that this constraint does not relieve the Navy from preparing an EIS that fully discloses the environmental consequences of the action without revealing classified information. Navy regulations permitting selective classification of sensitive portions of EISs can harmonize appellees' duties under the Atomic Energy Act with the requirements of the National Environmental Policy Act.
