Baton Rouge, City of v. EPA
ELR Citation: ELR 20546 No(s). 78-2719 (5th Cir. Jun 30, 1980)
The court dismisses a petition for review of an Environmental Protection Agency (EPA) order requiring petitioner to submit to the Agency a program for improving the performance of its sewage treatment plant. Under §509(b) of the Federal Water Pollution Control Act, the courts of appeals have jurisdiction to review only a narrowly defined class of EPA actions. Because §309 compliance orders are not specifically made reviewable, the court lacks jurisdiction over the case and the petition is therefore dismissed.
