A district court granted in part and denied in part summary judgment for environmental advocates, states, and municipalities in a lawsuit concerning implementation of EPA's 2024 revised NAAQS for fine particulate matter that strengthened the nonattainment threshold from 12.0 µg/m3 to 9.0 µg/m3. Plaintiffs argued the CAA required EPA to promulgate designations by February 7, 2026, and sought an injunction ordering EPA to promulgate them. The court found that because EPA did not dispute that it failed to timely fulfill its nondiscretionary duty, summary judgment was appropriate. It ordered EPA to promulgate final designations for all areas of the country no later than February 6, 2027.
