The Seventh Circuit affirmed remand to state court of a climate liability lawsuit against major fossil fuel companies. The city of Chicago sued the companies in state court, alleging they misrepresented the effects of fossil fuel emissions on global warming and seeking compensation for harm resulting from the increase in fossil fuel consumption attributable to the misrepresentations. The companies removed the suit under the federal officer removal statute, arguing it related to their fuel production for the federal government. A district court disagreed and remanded to state court. The appellate court concluded the companies' federal work was too attenuated from Chicago's claims to support removal at this time. It affirmed remand.
