A district court denied the California Department of Parks and Recreation's motion to preliminarily enjoin an energy company from using a four-mile segment of an oil pipeline buried below ground in Gaviota State Park. The state argued the company was trespassing on the park's land because a previously granted easement had expired. The court found California failed to demonstrate it would suffer irreparable harm absent injunctive relief because the pipeline had operated for nearly 30 years below the land without incident. It denied the motion.
