A district court dismissed for lack of standing an OCSLA citizen suit concerning offshore oil and gas activities in the Santa Barbara Channel. Nonprofit groups argued BOEM's decision determining that a company was not required to revise the development and production plan for a restarted platform in the channel was arbitrary and capricious, and violated OCSLA and its implementing regulations. The court found the groups demonstrated a prospective environmental injury in the possibility that the platform might result in a future oil spill, but had not shown a procedural injury—neither their standing declarations nor pending motion for summary judgment demonstrated that OCSLA or its regulations afforded them a procedural right to revision of a development and production plan. It concluded the groups' injuries were not redressable through an OCSLA citizen suit and dismissed for lack of subject matter jurisdiction.
