A district court denied environmental groups' motion for preliminary injunction in a challenge to a logging project in southern Oregon. The groups argued FWS and BLM violated the ESA in assessing the project's impact on the northern spotted owl, and that the project violated FLPMA because it failed to implement conservation measures for the northwestern pond turtle. The court found FWS' "zero take" determination in the biological opinion was neither arbitrary nor capricious and was adequately explained, and that the groups did not show BLM's use of location-based instead of timing-based mitigation was arbitrary and capricious or inadequately explained. It denied the groups' motion.
