A district court granted the state of California's motion to dismiss a challenge to two California laws—SB 253, Climate Corporate Data Accountability Act, and SB 261, Greenhouse Gases: Climate-Related Financial Risk—that require large businesses to publicly disclose their greenhouse gas emissions and report climate-related financial risk. Business groups argued the laws violated the First Amendment, the Supremacy Clause, and the Constitution's limits on extraterritorial regulation. California moved to dismiss the supremacy and extraterritoriality claims for lack of standing, lack of ripeness, and failure to state a claim. The court held that it lacked jurisdiction over the groups' claims to the extent they challenged SB 253 and dismissed those claims. It also dismissed for failure to state a claim the extraterritoriality claim to the extent it challenged SB 261.
