Town and County of Nantucket, Massachusetts v. Burgum

A district court granted the Bureau of Ocean Energy Management's (BOEM's) motion to remand and stay a challenge to its approval of a permit for an industrial-scale wind farm off the coast of Massachusetts. The town and county of Nantucket argued the approval violated NEPA, the National Historic Preservation Act, and the APA. BOEM moved to remand in light of a presidential memorandum directing the Secretary of the Interior to reconsider existing wind energy leases. The court granted the motion in the interest of judicial economy, as Nantucket supported remand and there was no evidence the wind farm developer would suffer significant and immediate hardship. It remanded to BOEM and stayed the suit pending the agency's reconsideration of the permit.
