The Fifth Circuit denied petitions to review FERC's approval of a natural gas pipeline expansion project in the Pacific Northwest. A pipeline company, two states, and two environmental groups challenged FERC's certification of the project and its denial of a predetermination for rolled-in rates. The court found FERC did not act arbitrarily and capriciously by denying the company's predetermination request, did not err under the Natural Gas Act by certifying the project or applying its long-standing policy to set initial rates, and did not violate NEPA by adopting its EIS and approving the project. It denied the petitions.
