A district court denied environmental groups' motion for a preliminary injunction in a challenge to the Forest Service's and FWS' approval of a logging project in Flathead National Forest. The groups argued FWS failed to adequately address cumulative impacts to grizzly bears in the biological opinion and failed to use the best available science. The court found the groups' delay in filing the motion over a year after the project's decision notice was signed weighed against a finding of irreparable harm, and that they failed to raise substantial questions going to the merits. It denied the motion for preliminary injunction.
