In an unpublished opinion, the Ninth Circuit affirmed summary judgment for the Forest Service in a challenge to its decision to approve a herd management plan for wild horses in Ochoco National Forest. A group of conservationists argued the Service violated the Wild Free-Roaming Horses and Burros Act (Wild Horses Act) and NEPA by adopting the plan, which involved removing horses from the forest. The court found the Service reasonably considered the available evidence and reached a reasonable decision in adherence to the Wild Horses Act and took the "hard look" required by NEPA. It affirmed summary judgment for the Service.
