Fore River Residents Against the Compressor Station v. Federal Energy Regulatory Commission

The D.C. Circuit dismissed for lack of jurisdiction a challenge to two FERC orders approving construction and operation of a natural gas compressor station in Massachusetts. Residents, municipalities, and an environmental group petitioned for review of the orders—one granting the station owner's request for an extension to complete the project and the other granting the owner's request to start operations—and of the Commission's denial of their request to rehear them. The court found it lacked jurisdiction over the extension order petition because the petitioners failed to demonstrate standing and the case was moot. Because FERC already remedied each of the complaints raised, there was no relief for the court to order. The court also found it lacked jurisdiction to consider petitioners' challenge to the order allowing the station to be put into service because the Commission's denial of rehearing was not a reviewable "order" under the Natural Gas Act.
