Ictech-Bendeck v. Waste Connections Bayou, Inc.
ELR Citation: 52 ELR 20134 No(s). 18-7889 c/w 18-8071, 18-8218, 18-9312, and 19-11133 c/w 19-14512 (E.D. La. Nov 29, 2022) (Morgan, J.))
A district court held that hundreds of Louisiana residents seeking damages in a mass tort action concerning landfill emissions in Jefferson Parish established general causation. The court found the residents proved by a preponderance of the evidence that gases and odors were emitted from the landfill, that these occurred during the time period at issue, and that they were capable of producing the injuries claimed by the residents—headaches, nausea, vomiting, loss of appetite, sleep disruption, dizziness, fatigue, anxiety and worry, a decrease in quality of life, and loss of enjoyment or use of property in the general population.
