The Ninth Circuit vacated EPA's denial of a petition to cancel the registration of the pesticide tetrachlorvinphos (TCVP). An environmental group petitioned the Agency to cancel the registration of TCVP for use in household pet products, and EPA denied the petition. The group argued the Agency erred because it failed to provide an adequate explanation for its decision and relied on several incorrect calculations. The appellate court found that EPA's denial was not supported by substantial evidence when considered on the record as a whole. It vacated the denial and remanded to the Agency for a revised response within 120 days.
