Oregon Natural Desert Ass'n v. Bushue

ELR Citation: 52 ELR 20039
No(s). 3:19-cv-1550-SI (D. Or. Mar 29, 2022) (Simon, J.)

A district court denied environmental groups' motion for a temporary restraining order in a challenge to BLM's authorization of livestock grazing on pastures containing research natural areas (RNAs). The groups argued BLM's regulations required fencing to be installed to section off the RNAs so they would not be grazed, and baseline data to be provided for research into greater sage grouse habitat recovery, and moved to enjoin the agency from allowing grazing on the pastures. The court found that the groups failed to show grazing would irreparably harm their research interests or the sage grouse population. It denied the motion for a temporary restraining order.
