Cascadia Wildlands v. United States Forest Service
ELR Citation: 52 ELR 20004 No(s). 6:21-cv-01225-AA (D. Or. Dec 27, 2021) (Aiken, J.)
A district court granted environmental groups' motion to preliminarily enjoin wildfire logging projects in the Willamette National Forest. The groups argued the Forest Service violated NEPA by failing to perform supplemental analysis for the previously approved projects to account for the effects of wildfires in the forest in 2020. The court found that the wildfires had clearly changed the conditions upon which the original EA and EIS were based, and that the groups would suffer irreparable harm in the loss of fire-damaged portions of the project areas. It granted the groups' motion and enjoined the Forest Service from permitting any further logging in the project areas.
