A district court granted in part and denied in part gasoline companies' motion for summary judgment in a lawsuit brought by the state of Maryland seeking to redress alleged contamination of its waters with methyl tertiary butyl ether. Maryland brought various common law claims and statutory claims under the state's Environmental Article (EA) regulations. The court found the state could not prevail on its claim for alleged violations of EA regulations on sites it previously found to be in compliance with the regulations, but that its remaining claims were consistent with Maryland's statutory and regulatory scheme and with due process. It therefore granted summary judgment for the companies as to the one claim, but denied it with respect to all other claims.
