Friends of Animals v. Bernhardt

The Tenth Circuit affirmed in part and reversed in part summary judgment for FWS in a challenge to the Service's redaction of importer names in response to FOIA requests regarding the import of African elephant and giraffe parts. The appellate court concluded that withholding importers' names under FOIA exemptions for personnel or medical files and records or information complied for law enforcement purposes was proper as to the group's request concerning giraffe parts because the lack of public interest in giraffe imports meant that an invasion of privacy would not be warranted, but that withholding was not proper as to its request concerning elephant parts because the public interest in disclosure outweighed the privacy interest at stake such that disclosure was not unwarranted. It therefore affirmed in part and reversed in part summary judgment for the Service.
