A Minnesota appellate court remanded a challenge to the Minnesota Pollution Control Agency's (MPCA's) grant of an air emissions permit for a proposed copper-nickel mine in northern Minnesota. Environmental groups argued the MPCA improperly issued the permit because the company receiving it did not intend to comply with operational limits. The court concluded the agency had not adequately explained the reasons for its conclusions that the company was anticipated to comply with the terms of the permit or that the company did not fail to disclose relevant facts and did not knowingly provide false or misleading information. It therefore remanded to the MPCA for further consideration and additional findings.
