A district court dismissed a lawsuit concerning the city of Chicago’s delay in issuing an operating permit for a recycling facility in the city’s Southeast Side neighborhood. The company argued its constitutional rights were being violated as a result of the city’s delay of the permit review process at EPA’s request while additional environmental justice analysis was being conducted. The court found that because the city had not made a final decision in regard to the operating permit, the company’s takings claim was not yet ripe. It therefore dismissed the suit for lack of jurisdiction.
