Humane Society International v. United States Fish and Wildlife Service
ELR Citation: 51 ELR 20053 No(s). 16-720 (TJK) (D.D.C. Mar 29, 2021) (Kelly, J.)
A district court granted summary judgment for a nonprofit group in a lawsuit seeking FOIA disclosure of records maintained by FWS regarding the import and export of wildlife. The group challenged the Service's redaction of certain information pursuant to a FOIA exemption for trade secrets and commercial or financial information. The court found that FWS failed to show that the redacted information was customarily or actually treated as private, and thus could not be withheld as confidential under the exemption. It therefore granted the group's motion for summary judgment.
