In an unpublished opinion, the Ninth Circuit affirmed a summary judgment for the U.S. Forest Service in a challenge to its proposed logging project in Flathead National Forest. Environmental groups argued that the Service violated the National Forest Management Act (NFMA) and NEPA by failing to ensure that the project complied with the national forest land and resource management plan's road density objectives for grizzly bear and elk habitat. But the court concluded the agency demonstrated compliance with the forest plan and thus did not violate the NFMA or NEPA. It therefore affirmed summary judgment for the Forest Service.
