North Dakota v. U.S. Environmental Protection Agency
ELR Citation: 48 ELR 20163 No(s). 3:15-cv-59 (D.N.D. Sep 18, 2018) (Hovland, J.)
A North Dakota district court enjoined in Iowa the 2015 Clean Water Rule, which clarifies the definition of "waters of the United States" that are protected under the CWA. The governor of Iowa sought an order from the court expressly stating that the Clean Water Rule was enjoined in Iowa following the Sixth Circuit's nationwide stay of the rule and the District of South Carolina's ruling reinstating the rule. The court found that the governor's request showed good cause, and therefore enjoined the rule in Iowa.
